Vehicular Homicide Charge Dropped In Firefighter Death

DENVER (CBS4)- Prosecutors have dropped vehicular murder charges in an accident that killed a local firefighter.

Jeffery Harrington will face a DUI charge but not the vehicular murder charge in the death of David Truax in Dec. 2010.

Investigators believe Traux opened the door of the SUV – driven by Harrington- while it was moving and tried to get out. He struck his head on the pavement and died. Truax was a firefighter with South Metro Fire Rescue.

Harrington faces the DUI charge because investigators said he was driving on the wrong side of the road on Cherry Creek North Drive.
