Bartlett man accused of reckless manslaughter, DUI in boy's tubing death
A Bartlett man was ordered to jail with a $ 1 million bond this morning after he was charged with reckless manslaughter and aggravated DUI in the death of a 10-year-old boy who was tubing on the Chain O'Lakes with his family.
Lake County authorities allege David Hatyina, 50, had cocaine and alcohol in his system when his boat ran over 10-year-old Tony Borcia of Libertyville, killing the boy in late July. The accident was witnessed by Tony's father, who was driving a boat towing him on a tube, and some of his siblings.
The father and siblings on "saw a big white boat heading for Tony," prosecutor Ari Fisz said after the hearing. They waved and screamed for the boater to stop, he said.
"Despite that, the boat ran over the boy," said Fisz.
Family members clutched each other and wept quietly in the courtroom, with several wearing buttons with the child's photograph.
They released a statement after the hearing that said that the boy's death "turned our world upside down and changed our lives forever. Our beloved 10-year-old baby boy, Tony Borcia, was at one moment enjoying a fun-filled afternoon with his family, smiling, laughing, and having the time of his life. The next moment, he was taken from us forever."
"There are other victims of this horrific event. Tony's father, Jim, brother Joe, and sisters, Kaeleigh and Erin, all witnessed the brutal and sudden death. … They witnessed the aftermath in that water, a scene that was so horrific that it cannot be described in words. Then, Jim had to call Tony's mom, Margaret, while she was at home alone, and tell her that her baby boy was dead."
