Attempted homicide charge dropped against York man in gang shooting

Officials say charges against Tyree Eatmon were dropped last week so the York County District Attorney's Office could pursue a consolidated case.

An attempted homicide charge was dropped without prejudice against Tyree Eatmon, 24, of York last week in connection with a shooting that left one woman with a gunshot wound to the head.

During the Sept. 2 fight at Route 30 and Pennsylvania Avenue, members of the Southside gang assaulted members of the Parkway gang, police said.

Glenniece Banks of York suffered a gunshot wound to the head and her family says she continues to recover from her injuries.

Eatmon was previously charged with criminal attempt of homicide, but that charge was dropped at a preliminary hearing on Thursday, according to Chief Deputy Prosecutor Tim Barker. Eatmon faces an aggravated assault charge in connection a fight prior to the shooting.

"We withdrew the shooting charges in order to follow up on leads against all gunman -- there were multiple shooters involved in that portion of the incident," Barker said. "We wish to pursue those leads and prosecute the shooters together in a consolidated case. Withdrawing at this time will allow us to do that."

Barker added that withdrawing the charges does not "clear" Eatmon in the shooting and withdrawing without prejudice will allow the York County District Attorney's Office to refile charges "should such action in the future remain appropriate."

Barker said they are proceeding with aggravated assault charges against Eatmon, Maurice H. Atkinson Jr., Xavier Maddox and LaQinn Ralphael Harris for the "onslaught" against Donald Layton Jr. and Niam Jamison.

Police previously said that the group of men stomped on and beat up Layton and Jamison during a fight that started in the Five Guy's Burgers and Fries parking lot before spreading into the Rutter's Farm Store parking lot along Route 30.

Barker said the beating was caught on a cellphone video.

Eatmon remains free on bail.
