Murder charges dropped against Hampton man

HAMPTON – A murder charge was dropped last week against a Hampton man charged in a 2010 fatal shooting.

Melvin Orlando Rushing Jr., 23, was charged in the death of 21-year-old Travis Lamont Jones, of Newport News. The charges that were nolle prossed — meaning they were dropped but can be brought back if more evidence is discovered — were murder, two counts of use of a firearm, and robbery, according to court documents filed in Hampton Circuit Court.

The charges were nolle prossed on a motion by the Hampton Commonwealth's Attorney's Office. Karen Rucker, deputy commonwealth's attorney, said the charges were dropped due to insufficient evidence. She said police are still investigating the case.

Jones was found shot in the back May 31, 2010, in a parking lot behind Newmarket Square shopping center. When Rushing was charged with Jones' murder a day later, police said that Jones was robbed and shot while riding in a car with Rushing near Threechopt Road and Orcutt Avenue. Witnesses told police that Jones was dumped by a man who was traveling in a silver Nissan Altima. Jones died an hour later at a local hospital.

This is the second set of charges to be dropped against Rushing.

In 2009, Rushing was one of two men charged with abduction and firearms charges in connection with forcing four McDonald's employees into a walk-in freezer at gunpoint on South Mallory Street in Phoebus. The charges against Rushing were dropped last year due to insufficient evidence. The other man charged in connection with the armed break-in, 21-year-old Shawn J. Harris, was sentenced to 23 years in prison.

Two other murder cases have been dropped recently due to a lack of evidence.

Murder charges were dropped against three men in December in connection with the death of Ricky Keon Calloway Jr., of Hampton, in July 2, 2010. Second-degree murder and firearms charges were dropped against Prince Bell, 25, of Newport News; Marcus Moody, 22, of Hampton; and Kwaume Edwards, 22, of Newport News.

In Newport News, a murder charge was dropped in December against 18-year-old Demonte Leon Brown. Brown was charged in the Feb. 21, 2010, shooting death of Randy Sloan. First-degree murder and firearm charges against Brown were nolle prossed due to a lack of evidence.
