The woman's boyfriend, who is the gun's owner, was also charged. "Nothing is sadder than the death of a child, and when the death is the result of criminal negligence, there needs to be accountability," Pierce County Prosecutor Mark Lindquist said Wednesday. "Guns are inherently dangerous, and the law, as well as common sense, requires that guns be handled responsibly, especially around children." The mother, Jahnisha McIntosh, 23, and her boyfriend, Eric Vita, 22, made their initial appearance on the second-degree homicide charges Wednesday afternoon in Pierce County Superior Court. Detectives scheduled a meeting in the south area with volunteers, who will help distribute and post fliers with Dwight's picture and information about the case. End near in murder trial of lawyer representing himself

Image
NEWARK, N.J. - A defense attorney representing himself at his own murder trial closed the testimony portion Wednesday the same way he began it nearly a month ago, assailing the government's contention that he conspired to murder a federal informant who was to testify against one of his clients. Paul Bergrin called two witnesses in his defense Wednesday - one the ex-girlfriend of the man who admitted shooting the informant on a Newark street in 2004 - then engaged in a sharp exchange with an FBI agent called as a rebuttal witness by the government. Under cross-examination by Bergrin, FBI Special Agent Shawn Brokos conceded she made no notes from her interview with Rashidah Tarver, whose ex-boyfriend Anthony Young is serving a prison term for shooting Deshawn "Kemo" McCray and is a key witness against Bergrin. Tarver testified she told Brokos that Young had given her several different versions of McCray's murder. "Didn't you think that was relevant" ...

True test: Double murder

Image
By The Palm Beach Post In Boynton Beach these days, doing nothing can be better than doing something. That was the case with the city commission's decision not to conduct a study of the police department. The idea arose last summer, when five officers were arrested - four within one week. Chief Matthew Immler defended the department, noting that in-house procedures had flagged most of the bad cops, whose cases the department referred to the Palm Beach County State Attorney's Office. Still, there was commission sentiment for a look at hiring standards. Consider, though, what has happened since then. Former Mayor Jose Rodriguez pushed hard for the study in November. On Jan. 27, he was charged with three counts of public corruption. All the charges relate to Mr. Rodriguez's alleged efforts to make first Chief Immler and then interim City Manager Lori LaVerriere have the police department drop a domestic assault investigation of him. Gov. Scott suspended the mayor. The n...

Decades-old case drives up Pr. George’s homicide count

For decades after he was shot and left for dead on the side of the Capital Beltway in Prince George's County, John Nucci, a paraplegic, lived a productive life. He started a temp agency for restaurant workers. He opened his own restaurant in Leonardtown. But when Nucci, 50, died earlier this year at Washington Hospital Center, the D.C. Medical Examiner's Office determined complications from gunshot wounds were the to blame. The man brutally attacked in 1989 became Prince George's County's 12th homicide victim of 2012. Counting homicides is serious and sensitive business for police agencies in the D.C. region. Though crimes like break-ins and car thefts are more likely to touch the lives of the average residents, murders have become a sort of measuring stick for police chiefs and their departments. Keep the count low and the closure rate high, and politicians community activists and journalists will rate you well. Oversee a spike in slayings, and you'll face tou...

Erie murder suspect charged with assaulting woman, attempting to steal car

Image
Police said they have found no evidence so far to support Erie murder suspect David A. Fry's claims of killing other people. Fry, 33, remains in the Erie County Prison without bond on charges of bludgeoning 36-year-old Matthew Lyons to death at Lyons' apartment at Highpoint Towers, 2314 Sassafras St., on Saturday. He is also charged with attempting to rob an east Erie gas station, attempting to steal a woman's car at a west Erie grocery store and robbing three stores in suburban Pittsburgh. At the time of Fry's arrest shortly after police said he robbed a convenience store in Edgewood, east of Pittsburgh, on Monday night, police said Fry stated that he had killed eight or nine people. He also stated "that last guy I beat his brains in" and "I killed that (expletive)," apparently referring to Lyons. When asked by reporters on Wednesday night if he had killed others, Fry said yes. Edgewood Police Chief Robert Payne said today that his department...

Defense attorneys present opening statements in Longoria murder trial - Wichita Eagle

Image
Adam Longoria's attorneys will try to convince a jury that someone else killed 14-year-old Alicia DeBolt and that the state's case is largely circumstantial. During opening statements, the defense attorneys — Jeff Wicks and Tim Frieden — pointed out to jurors what they consider a number of inconsistencies in the state's case against Longoria, 38, an ex-con accused of becoming obsessed with a 14-year-old girl, murdering her and setting her body on fire to hide the crime. Longoria is charged with capital murder and if convicted would face life in prison without possibility of parole. Opening statements started at about 1:30 p.m. Thursday after more than three days of jury selection. The jury — nine men and five women — were selected from a pool of 400 potential jurors. Two of the jurors are alternates. Wicks claimed in opening arguments that: •  A footprint found near Alicia's charred body did not match Longoria. •  Another male's DNA was found in her body. Th...

Erie homicide suspect David A. Fry has been charged with committing another crime in the city. Fry, 33, was arraigned before Erie 6th Ward District Judge Dominick DiPaolo Wednesday night on charges in the assault of a 70-year-old woman outside a westside grocery store on Friday. Police accuse Fry of pushing the woman into her 2011 black Chrysler 2000, and elbowing her numerous times in the head, face and body, in an attempt to steal the car outside of the Tops Friendly Markets, 1520 W. 26th St., according to the criminal complaint filed in the case. Homicide trial goes to jury

Image
WAUPACA — A jury will begin deliberations today in the first-degree intentional homicide case against a New London man accused of killing his elderly neighbor in 2007. The prosecution and defense concluded their cases Wednesday in Waupaca County Court in the trial of Chad W. Magol- ski. The 35-year-old is accused of killing 77-year-old James Park in December of 2007. Prosecutors say an unemployed Magolski killed Park and stole his money to make a partial payment of rent under threat of eviction from his landlord. Magolski's attorneys say their client is innocent and was tried based on coincidence supported by flimsy evidence. Assistant Atty. Gen. David Wambach this week acknowledged the case was built on circumstantial evidence, which included Park's DNA on one of six $ 50 bills handed over to police by the landlord. One of those bills was given to the landlord by Magolski the same week as Park's stabbing death. Magolski and Park lived in a house split into three ...

Homicide suspect claims others dead

An Erie man who police say was bludgeoned to death by a Westmoreland County convict will be buried on Friday alongside his mother. Matthew Lyons, 36, was found dead of head trauma in his apartment on Sunday. Erie detectives were traveling to Pittsburgh on Wednesday to pick up David Fry, 33, of Hempfield for his arraignment on homicide and other charges. Frances and Matthew Lyons will have a joint funeral at the Monreal Funeral Home in Eastlake, Ohio, on Friday. Lyons family members declined comment. As they prepare to memorialize their loved ones, police are investigating Fry's claims that he killed "eight to nine" other people. Homicide hits close to home

Image
Small Text Medium Text Large Text LA CROSSE, Wis. -- Imagine coming home one night to a police investigation. That was the reality for Sara Hougom's neighbors, who say the 20-year-old's fatal shooting has them on edge. The homicide hits close to home for Mike Randall, who lives in the same apartment building. "She was just on the other side of my wall from where my bedroom is. That's one of the first things that struck me, was that, from where the police were checking the walls to see if there were bullet holes inside my house. It must have been some eight to 15 feet from where I sleep at night. So that kind of freaked me out a little bit," said Randall. Randall had only met Hougom a handful of times, coming and going from their apartment building. He said he also went to her birthday party. "It was kind of just numbing, just because you hear about things happening like that, but you never think it's going to happen anywhere that close...
