June manslaughter rate declines in San Bernardino

Image
SAN BERNARDINO - The city's spike of 12 killings in May dropped to four in June. Can the decline be attributed to extra police patrols, sweeps or arrests? Or is it the natural ebb and flow of crime? The reason remains to be seen. "I think we can do everything possible and still have manslaughters," said Police Chief Robert Handy. "I would like to think some of the things we've done have reduced it, but sometimes there are spikes in crime where there's no real reason for it." San Bernardino police have been busy focusing on violent crime, including 50 arrests and the seizure of 33 guns by the department's violent crimes task force since March. Many search warrants served by the team have been in areas where manslaughters have occurred. An additional 90 arrests - mostly gang members - were made on June 13 during a crime sweep, but that operation was scheduled before May's rash of manslaughters. Police said they have been taking pre

Ex-Oakland Raider accused of murder to be retried next week

Image
Jury selection in the retrial of Anthony Wayne Smith, a former Oakland Raiders defensive end accused of murdering a Lancaster mechanic, is scheduled to begin Monday, his defense attorneys said. Michael S. Evans, who is representing Smith, said the new trial was set to take place in the Antelope Valley courtroom of Los Angeles County Superior Court Judge Carlos A. Chung. Smith's original trial, for his alleged role in the killing of 31-year-old Maurilio Ponce on Oct. 7, 2008, ended in a hung jury in April when the panel failed to reach agreement on a verdict. After nine days of deliberation, jurors split 8 to 4 for a guilty verdict, according to the Los Angeles County district attorney's office. Smith, 44, who played professional football with the Los Angeles and Oakland Raiders in the 1990s, has remained in custody since the trial, Evans confirmed. Also charged in connection with Ponce's death and awaiting trial is 33-year-old Dewann Wesley White of Bloomingto

Murder conviction could be overturned Friday - msnbc.com

Image
A man convicted of killing a North Carolina A&T professor in 1988 could be exonerated Friday after new technology allowed investigators to identify a different "person of interest." Lamont Armstrong, now 62, was convicted in the murder of Ernestine Compton on July 12, 1988. Key to the conviction was testimony from a convicted felon who has since said police pressured him to accuse Armstrong. However, on Friday afternoon, prosecutors will move for a retrial in the case, naming Christopher Bernard Caviness as a "person of interest" in the murder. Caviness was convicted in the murder of his father in 1989. After his release from prison, he was killed in a car crash in 2010, Greensboro police said. Caviness was linked to the case after a match to a partial palm print that was lifted from a door frame just above Compton's body. Greensboro police, an independent examiner and the State Crime Laboratory each produced the same match to the print database,

Halifax Regional Police are busy in the city's north end this afternoon in relation to the ongoing murder investigation in the death of Ryan Matthew White, the CBC has learned. Police found White on the pavement outside a building in the Mulgrave Park public housing complex two years ago. He was suffering from a chest wound. Today, police are combing the area between Union Street and Devonshire Avenue, just below Fort Needham Park. Homicide investigators, the identification unit, as well as the canine unit and other officers are on scene. They're using metal detectors in a heavily wooded area where there are walking trails. Const. Brian Palmeter told CBC News, police are searching for evidence. "We received information recently with respect to the ongoing investigation, that has led investigators back to search this area," he said, "Obviously I can't get into what we're looking for but we believe there's evidence here that will help us

Laboard manslaughter charges appropriate, lawyers say

Image
Only James D. Laboard knows his intentions the night Baltimore County police said the off-duty officer chased a group of teens who had thrown a rock at his home. But as authorities considered charges in the ensuing death of Christopher Brown, they had to try to discern Laboard's intentions. Laboard was charged with two counts of manslaughter — one involuntary — in the asphyxiation death of the Randallstown High School teen; either count could carry a 10-year sentence. Download The Baltimore Sun's new iPhone app. The victim's mother expressed outrage that the officer isn't facing more severe charges, alleging that the officer received preferential treatment and calling for an outside investigation. But several legal experts said the manslaughter charges may be the strongest possible, given what's known about the case. The difference between manslaughter and murder charges centers on whether a suspect intended to kill. Experts pointed out that according to th

Murder accused under assessment

MICHAEL FOX AND VICTORIA ROBINSON JOHN SELKIRK/Fairfax Media CRIME SCENE: A forensic team search the property in Balmoral Rd, Auckland, where a man was found dead. A 38-year-old man charged with the murder of a man in Balmoral on Tuesday night has been sent for mental health assessments and been granted interim name suppression. The man appeared in Auckland District Court this afternoon, where Judge Grant Fraser ordered his name be suppressed so members of his family could be told about the murder charge. Judge Fraser said the suppression is unlikely to be extended at the man's next court date. The man was remanded to the Mason Clinic - a psychiatric hospital where it will be assessed as to whether he is fit to stand trial. A forensic court liaison nurse told the court she recommended the man be given 24-hour care by trained professionals, rather than be sent to prison where he could not be given round-the-clock assistance. Three men accused in separate homicide cases were freed from the Lane County Jail today in the final wave of releases driven by the county's shrinking budget. Homicide Investigation Update

Image
The Birmingham Police Department reports that detectives have received a ruling from the Jefferson County District Attorney's office related to a homicide investigation. The incident occurred on Tuesday, June 19, 2012 at approximately 4:45 p.m. at 556 Avenue V.   The victim has been identified as: Deandrea Thomas, B/M, 22, of Birmingham, Alabama.    Homicide investigators presented the case to the District Attorney's office who acknowledged that the case will be ruled as a justifiable homicide. The District Attorney's office advised investigators the ruling was due to the fact that the shooter was acting in self-defense when he shot the victim. During the course of the investigation, detectives learned that the shooting victim attacked the shooter, striking him with fist and banging his head against the wall while choking him.   The suspect that surrendered to investigators was released. There are no arrests in this case.  The Birmingham Police Department reports that det

Sanford detective wanted homicide charge for George Zimmerman (+video)

Sanford Police Detective Chris Serino recommended a homicide charge for George Zimmerman, who killed Trayvon Martin. The detective has been reassigned as uniformed patrolman on the graveyard shift. George Zimmerman had a broken nose, a bruised head and passed two voice-stress lie-detector tests in the wake of his deadly fight with Miami Gardens high school junior Trayvon Martin. Skip to next paragraph But police records released Tuesday show in greater detail how the Sanford detective investigating the case was unconvinced that Zimmerman was legally justified when he shot Martin. Detective Chris Serino believed Zimmerman jumped to a "faulty conclusion" about Martin, an unarmed teen who he said never used deadly force when he battered Zimmerman and caused him to frantically scream for help 14 times. Days after several recorded interviews between Serino and Zimmerman were made public, the detective got a new job: On July 7, he starts in his new assignment as a un

Homicide trial date set for former Bridgewater councilman

Image
BEAVER — A date has been set for the homicide trial of a former Bridgewater councilman accused in a 32-year-old murder in Monaca. Gregory Scott Hopkins, 66, of 718 Mulberry St., Bridgewater, is scheduled to face trial on Sept. 4 before Beaver County Judge Richard Mancini. He is being held without bond in the Beaver County Jail. If the date stands, Hopkins would face trial almost exactly 33 years after the body of Catherine Janet Walsh, 23, was found Sept. 1, 1979, inside her Indiana Avenue, Monaca, home. She was strangled. Hopkins, who had a sexual relationship with Walsh in the months leading up to her death, was not charged at the time because a friend provided an alibi, and police had no evidence directly linking him with the crime. But police were able to use advances in DNA technology to match samples found on Walsh's nightgown and the rope used to tie up her hands to Hopkins and charged him on Jan. 29. Through his lawyer, James Ross, Hopkins has continued to

Oland homicide documents remain sealed another month

Image
Documents related to the Richard Oland homicide investigation will remain sealed from the public for at least another month. Prosecutors had been seeking to have an existing sealing order on the search warrants extended for six months. But Provincial Court Chief Judge R. Leslie Jackson said on Wednesday he would not grant an extension without hearing new evidence. He said the Crown's request amounted to a new application — not just monitoring of the previous one — and the court must have some information on which to act. Jackson adjourned the matter until July 31 when one of the investigating officers with the Saint John Police Force will testify behind closed doors as to why the documents should remain sealed. The judge agreed to the Crown's request to keep members of the public out of the hearing, for fear that releasing the evidence could jeopardize the police investigation. But he ruled that a lawyer representing CBC News and the Telegraph-Journal, and two l
