Man cleared of manslaughter in '66 shooting still jailed

Image
PHILADELPHIA (AP) — The continued imprisonment of an elderly man acquitted of manslaughter charges filed after a police officer he shot in 1966 died in 2007 is a vindictive effort by authorities to have him die in prison and a violation of his constitutional right to due process, his lawyers argued Tuesday. William Barnes , 76, has been incarcerated since the August 2007 death of police Officer Walter Barclay , whom Barnes shot and paralyzed 41 years earlier during a botched burglary. Barnes had served 16 years for shooting Barclay but was charged with manslaughter after the officer died. Although a jury acquitted Barnes in May 2010, he remained in prison for having a cellphone and driving a car without his parole officer's approval at the time of his 2007 arrest. He was given six months for those technical violations but has been repeatedly denied parole. "The bottom line is he's going to get denied for different reasons every time," defense attorney Samuel Sil...

Murder conviction reinstated in La Jolla surfer case

Image
The California Supreme Court on Monday reinstated a murder conviction for the 2007 killing of a well-known, professional San Diego surfer by a former La Jolla High School football player. The state high court said Seth Cravens, a graduate of La Jolla High School, knowingly committed a life-threatening act when he punched surfer Emery Kauanui in the head and knocked him to the ground. Kauanui suffered severe head injuries and died a few days later. A lower court had reduced Cravens' conviction to manslaughter on the grounds that there was insufficient evidence he meant to kill Kauanui, 24. But Justice Marvin Baxter, writing for the Supreme Court, said the nature of the blow, a sucker punch, and Cravens' behavior before and after the fight showed he acted with "implied malice," knowingly committing an act that could kill. Justice Joyce L. Kennard dissented, saying the evidence did not support a murder conviction. Cravens, who was 21 at the time of the crime, w...

Adnan manslaughter: Four acquitted in case linked to Orkut - NDTV

Image
Mumbai:  A Mumbai court has today acquitted four men accused of kidnapping and manslaughtering Mumbai teenager Adnan Patrawala in 2007, who they had allegedly met via social networking site Orkut. The verdict is being read by the city as a moment of shame for the Mumbai Police, whose lethargic inquiry has belied what experts say was an open-and-shut case. The court said there was not enough evidence to prove that the arrested men are guilty. A fifth - who is a minor and is being tried separately - is also likely to be declared innocent.   At a press conference today, Adnan's father, Aslam, steered clear of criticising the police, saying only that he would appeal to a higher court. "We are satisfied with what the police have done. I don't know what went wrong," he said. At the court, another father expressed his thanks. "I am relieved that my son is innocent. The way he was trapped anything could have happened to him,'' said Arun Bhatt, whose young son...

Colorado Springs homicide investigators look for answers after deadliest year ever

Image
COLORADO SPRINGS — The night was quickly going south. Just after 8 p.m., a 60-year-old parolee had shot two people — killing one — in an AutoZone parking lot. Less than 20 minutes later, officers on a domestic-violence call shot a 21-year-old who threatened to kill his girlfriend and then pointed a gun at them. Lt. Kirk Wilson, the man in charge of the Colorado Springs Police Department's homicide unit, was en route to that second shooting when the worst call of the night came in: Three teenagers, two of them brothers, had been shot, apparently victims of road rage. Two of the young men already were dead. The third would be pronounced dead a short time later, making July 27, 2011, the deadliest night in what would turn out to be the deadliest year in Colorado Springs history. There were 32 homicides here last year — a 33 percent increase over 2010 and four more than the previous record, set in 2007. While the city's 2011 murder rate remains close to or lower than compar...
