Murder charges filed in shooting

A man was formally charged Friday in the shooting of a 47-year-old father outside the Hive nightclub last week.

Marvin Rosario-Lopez, 24, was charged with first-degree murder after deliberation, and first-degree murder with extreme indifference.

The fatal shooting occurred early Sunday near the intersection of 11th Avenue and Lincoln Street when a brawl inside the nightclub's dance floor spilled into the street.

Ronald Smith had been at the club with his wife to watch his youngest son — rapper Andrew Smith — perform.

was getting ready to leave when a fight broke out between his older son, Devin, and another man. The two men were thrown out of the club by security guards.

Smith saw his older son in the street bleeding and decided to confront the man he believed had smashed a beer bottle onto his older son's head.

That's when police say Smith was shot and killed.

Security guards detained Rosario-Lopez at the scene until Denver police arrived to take him into custody.

Rosario-Lopez remains in custody and is being held without bond.

He is scheduled to appear in Denver district court on Nov. 13.

Colorado Bureau of Investigation records show that Rosario-Lopez had previously been arrested in May 2007 for possession and sale of drugs. He was convicted and sentenced to two years' probation.

In August 2007 he was arrested on similar charges.

The charges in the murder come just a day after police held a meeting to calm the Capitol Hill residents and to ask for help in solving another murder in the neighborhood that happened the same weekend.

On Nov. 2, Ryan Haldeman, 28, was stabbed to death as he headed home from Pub on Penn at East 13th Avenue and Pennsylvania Street.

Police have few leads in that case, and have not made an arrest.
