Man charged with homicide turns up in Mercer County - Beaver County Times

The first person charged with criminal homicide in Beaver County in 2011 spent Sunday overnight in the Mercer County Jail before being returned Sunday afternoon to Beaver County, according to multiple police and court sources.

Robert Allen Maier, 60, of 105 Terrace Lane, New Sewickley, was charged with criminal homicide Saturday by Rochester Borough police officer Jeffrey Lizzi, according to court documents. Maier fled the scene and was not apprehended for nearly 10 hours. There are no related charges. There were two adults and two children present at the time of the shooting.

Rochester Detective Dawn Shane said Saturday that Maier shot Matthew Rose, 31, with a handgun in the kitchen of a residence at 409 Jackson Street. Shane identified Rose as the son of Maier's girlfriend, who was not identified. Maier's girlfriend resided in the house where the shooting took place, according to police.

Maier was brought to the Mercer County jail by Greenville police shortly after midnight Saturday and remained in the jail until officers from the Beaver County District Attorney's office arrived shortly after noon Sunday to take custody of him, according to a spokesman at the Mercer County Jail.

The Mercer County jail spokesman was unable to say if Maier turned himself into officers or if he was apprehended in flight, and neither Greenville or Rochester police responded Sunday to a queries from the Times.

According to online court records, Maier had no previous criminal record.

Maier, from the Beaver County jail, received a video arraignment shortly after 10 p.m Sunday before District Judge Janet Swihart. Maier said "I believe not" when Swihart asked if he had any questions about the homicide charge. He acknowledged that he wanted a public defender to represent him Dec. 12 at a preliminary hearing at the Beaver County Courthouse.

Swihart told Maier that she could not offer bail to someone charged with homicide.

According to a criminal complaint written by Lizzi and made available at Maier's arraignment, police received a call from Brandi Bentz, age and address not available, at 2:35 p.m. Saturday saying that Rose, her boyfriend, had been shot three times.

Bentz, according to Lizzi's report, told police that Maier and Rose were in the kitchen when Maier "unexpectedly brandished a black in color handgun and proceeded to shoot the victim."

Rose, according to the report from Bentz to police, attempted to run through the kitchen door and climb over a fence, but Maier followed Rose and shot him two more times. Police found Rose on the ground between residences at 409 and 411 Jackson Street and he died at 4:42 p.m. at Heritage Valley Beaver hospital.

Bentz told police that her two children and another adult female were in the living room of the residence at 409 Jackson St. when Maier began shooting.

District Attorney Anthony Berosh of Beaver County, in a Nov. 3 interview with the Times, said Beaver County had not yet had anyone charged with criminal homicide in 2011.
