Murder conviction quashed with medical advances

A man convicted of murder three decades ago has had his conviction quashed after winning an appeal based on advances in medical science which showed an ulcer which resulted in the victim's death was not caused by stress during a robbery. Chris von Deutschburg won his appeal against his 1983 conviction for murdering 86-year-old Stavros Kakulas after the Court of Appeal this morning found there had been a miscarriage of justice at his trial. His conviction was set aside and he was acquitted. In a unanimous decision handed down this morning, Court of Appeal president Carmel McLure and Justices Michael Buss and Robert Mazza found the medical evidence before the court was incapable of proving beyond reasonable doubt that Mr von Deutschburg's assault on Mr Kaklus caused or "materially contributed" to his death. Homicide suspect charged with child pornography

RACINE — A Sturtevant man accused of first-degree manslaughter is now facing nine counts of possession of child pornography. Local law enforcement learned about the alleged sexually explicit images and videos as well as a membership to a child pornography website during an investigation into Keith M. Abbott, 49, for the stabbing death of a Racine woman in early 2011, according to a criminal complaint. A computer that was reportedly used by Abbott at his residence in the 8600 block of Camelot Trace was voluntarily turned over to the Racine County Sheriff's Office as part of the manslaughter investigation, according to the complaint, and later analyzed by the Department of Justice, who discovered nine images and four videos of child pornography. The materials also were submitted to the National Center for Missing and Exploited Children who reported to the Sheriff's Office that five images and four videos located on the computer were identified as known victims of child

Camden homicide is the third this week

Shortly after midday, the Breaking News Network reported a shooting on the 1200 block of Chase Street in the Whitman Park section. Jason Laughlin, a spokesman for the Camden Count Prosecutor's Office, confirmed the slaying, but he didn't immediately have additional information. The killing is the third this week. On Tuesday, two men were slain in unrelated incidents in the Fairview section and in East Camden. The city had recorded four homicides this time last year, when a record 67 people were killed. JACKSON, Miss (Reuters) - A candidate for mayor of a small town in Mississippi was found dead by a river on Wednesday morning, the victim of an apparent manslaughter, police said. Marco McMillian, 34, was one of the first viable, openly gay candidates in Mississippi, according to the Victory Fund, a national organization that supports and endorses lesbian, gay, bisexual and transgender candidates and officials. The death of McMillian was not being investigated as a hate crime, said Will Rooker, a spokesman for the Coahoma County Sheriff's office. In addition to being gay, McMillian was African American. The death is not considered politically motivated, despite intense competition in the race for mayor of the Mississippi Delta city of Clarksdale, said Coahoma County Coroner Scotty Meredith. LAS VEGAS (AP) — Las Vegas triple homicide suspect Ammar Harris has a smirk on his face in a ninety-second YouTube video that shows him flashing a thick stack of $ 100 bills. The video provided by police is just one of many online displays of bravado that suggest a sinister side to Harris . The 26-year-old is the subject of a multi-state manhunt after a Maserati driver was shot dead on the Las Vegas Strip last Thursday and a taxi driver and passenger died in the fiery chain reaction crash that followed. Detectives announced Wednesday that the family of Ousmane Goudiaby has offered an additional $ 1,000 reward for any information that could lead to an arrest and conviction of the suspects involved. 30-year-old Ousmane Goudiaby was shot and killed on Jan. 27 in a business on the 2700 block of Westlane Road. His older brother says that someone has information about his death and should come forward. "The police have a tip already and I'm ready to put up another $ 1,000 on it," said Mamadou Guodiaby, Ousmane's older brother. "Today I'm crying. My heart is bleeding. JACKSON, Miss. (AP) — A Mississippi mayoral candidate was found dead Wednesday and the case is being investigated as a homicide, authorities said. Coahoma County Coroner Scotty Meredith said the body of 34-year-old Marco McMillian was found on the Mississippi River levee Wednesday at about 10 a.m. The 34-year-old McMillian was running for mayor of Clarksdale, a Blues hub where actor and Mississippi native Morgan Freeman co-owns a music club with Bill Luckett , who also is running for mayor. Meredith said the body was found between Sherard and Rena Lara and was sent to Jackson for an autopsy. He declined to provide further details or speculate on the cause of death. The sheriff's office said Wednesday in a news release on its Facebook page that a person of interest was in custody, but had not been formally charged. Homicide victim, 21, found in Fresno

A 21-year-old man is Fresno's eighth homicide victim this year, police said Wednesday. Police Lt. Mark Salazar said officers found the victim in the 3300 block of North Sierra Vista Avenue just before midnight Tuesday. He was taken to a hospital where he died about a half-hour later. The homicide appears to be gang-related and two detectives are investigating. It is not clear where the crime took place, Salazar said. Last year at this time, there were 10 homicides in Fresno. Tymoshenko Murder Case Is Disaster for Ukraine, EU Official Says

The murder charge against jailed former Prime Minister Yulia Tymoshenko is a "political disaster" for Ukraine, a European Union official said. A ruling by the European Court of Human Rights on Tymoshenko's conviction for abuse of office may come next month, according to Aleksander Kwasniewski, an ex-Polish president who monitors her situation on behalf of the European Parliament. Murder suspect's bond adjusted, remains incarcerated

FARMINGTON — A district judge adjusted a murder suspect's bond last Friday but the accused remained in jail Tuesday evening. Jacob Beach, 20, is charged with second-degree murder in the death of Sharolyn Keown, 18. Police arrested Beach Nov. 6 at the Enchantment Hotel in Aztec and charged him with an open count of murder. Magistrate Judge Stanley King originally set his bond at $ 500,000 cash only. During Beach's preliminary hearing in December, prosecutors amended charges from an open count of murder to murder in the second degree, which carries a penalty of up to 15 years in prison if convicted. Cosme Ripol, Beach's attorney, said during a pretrial conference in front of District Judge Bill Birdsall that Beach's bond was "definitely too high for a second-degree murder charge." Ammar Harris, 26, was wanted in connection with the Thursday shooting on South Las Vegas Boulevard and Flamingo Road. Tineesha Lashun Howard, also know as Yenesis Alfonzo, 22, from Miami, was identified as being inside of a black Range Rover at the time the shots were fired, police said. Howard is 5 foot 8 and weighs about 120 pounds. She has green eyes and dark hair. She's listed as missing and police believe she is in danger. Benedykt Nowak, 34, died and a 26-year-old man was injured in the fire in Dilloway Industrial Estate, The Green in Southall on 22 February. Cleveland Police investigate apparent homicide on west side

Fark it - A A A + CLEVELAND -- Cleveland Homicide Detectives are investigating after a man in his early 30s was killed on the city's west side. The incident happened on the second floor of a home in the 2200 block of West 101st Street at about 3 a.m. Cleveland EMS crews responded to a reported assault on a woman, but found a dead man at the scene. Police say a boyfriend and girlfriend got into a physical fight and during the fight, the girlfriend's brother, Adam Szajko, 21, got involved. Szajko put the boyfriend in a choke hold, police said. When police arrived, the boyfriend was dead. Officers arrested Szajko at the scene. The girlfriend from the fight was taken to Fairview Hospital. Her condition is not available. The official cause of death is under investigation by the Cuyahoga County Medical Examiner's Office. WKYC-TV

Three charged in Madison County with drug-induced homicide

EDWARDSVILLE — Two more cases of drug-induced homicide have been charged in Madison County, despite troubles in the past prosecuting such cases under state statutes. Robert J. Kirchner, 40, has been charged in the death of Tony Sellers, who was found dead outside Kirchner's home in June. Autopsy results showed he died of a heroin overdose. Kirchner is accused of buying heroin in St. Louis and delivering it to Sellers. According to police, then he and three others allegedly took Sellers' body out of the house and left it in the back yard to camouflage the cause of his death. In addition to the Class X felony of drug-induced homicide, Kirchner faces charges of multiple drug offenses and concealment of a homicidal death. The other three people charged are his wife, Vindi Kirchner; Janet Denson, and Scott Bourbon, all of Granite City. The 12-year-veteran of the Camden Police force is on administrative leave after the shooting at his home along the 2800 block of Arthur Avenue Friday afternoon, according to the Camden County Prosecutor's Office. Investigators have not identified the officer since he has not been charged with a crime. LAS VEGAS (FOX5) - The Clark County Coroner's office ruled the manner of each death in last week's Las Vegas Strip shooting and resulting crash as homicide. The coroner's office made the ruling in the deaths of Ken Cherry, Jr., 27, who died of a gunshot wound to the chest while behind the wheel of a Maserati, and two in a taxi cab – Michael Bolden, 62, and Sandra Sutton-Wasmund, 48. Bolden, the driver of the cab, and Sutton-Wasmund, a passenger in the taxi, died from multiple blunt force injuries and extensive thermal burns, the coroner also revealed. According to Las Vegas Metro police, Cherry's Maserati accelerated into the intersection at Las Vegas Boulevard and Flamingo Road, resulting in the crash with Bolden's cab about 4:20 a.m. on Feb. 21. OKLAHOMA CITY (AP) — First-degree manslaughter charges have been dropped against two men accused of killing a 19-year-old Oklahoma woman whose dismembered body was found in a duffel bag. Oklahoma County prosecutors filed a motion on Friday to dismiss charges against Jimmy Lee Massey Jr. and Luis Ruiz pending further investigation into the death of Carina Saunders . District Judge Ray Elliott signed the motion that states charges can be refiled in the future pending the outcome of the investigation. Saunders' dismembered body was found Oct. 13, 2011, behind a grocery store in the Oklahoma City suburb of Bethany. Last month, Bethany police asked the Oklahoma State Bureau of Investigation to take over the case. Investigators have said Saunders' death involved human trafficking and drugs. Homicide suspect Francisco Miranda arrested after nearly 20 yrs on the run

BETHLEHEM, Pa. - Officials in Northampton County have announced an arrest in a case of murder dating back to the mid 1990's. District Attorney John Morganelli announced the arrest of Francisco Miranda at a news conference Monday morning. Morganelli said Miranda is charged with the stabbing death of Jorge Antonio Velazquez in Bethlehem back in June of 1994. Morganelli said the stabbing happened during a game of dominoes behind an apartment building on Aaron Street. Officials say Miranda was named as a suspect on the day of the stabbing, but then left the country and was on the run for nearly 20 years. Miranda was caught in the Dominican Republic in November and was extradited back to the U.S., where he is currently at the Northampton County Prison, Morganelli said. The attorney for Oscar Pistorius' family said today that the Olympian's brother is facing a culpable manslaughter charge relating to a 2008 road accident in which a motorcyclist was killed. Carl Pistorius, who sat behind his younger brother, Oscar, every day at his bail hearing, will now face his own manslaughter trial for the accident five years ago, which his attorney, Kenny Oldwage, said he "deeply regrets." Carl Pistorius is charged with culpable manslaughter, which refers to the unlawful negligent killing of another person. The charges were initially dropped, but were later reinstated, Oldwage said in a statement.
